Terms of Service for Individual Users

DMCA Takedown

The Digital Millennium Copyright Act (DMCA) is part of US copyright law that protects content owners from copyright infringement on the internet. It is your right as a content creator to request removal of any content you own, or are the subject of, from our Website or any Website we manage on behalf of our Clients. Please send all DMCA takedown requests to data-protection@warpwire.net, including the URL of the offending content, your contact information, and your specific reason for a removal request.

Malicious Use of Warpwire

You agree to use the Application in accordance with all applicable laws. You are responsible for your own content, including the upload, creation, and sharing of media, and are responsible for the consequences of their posting on the Application. You further agree that you will not post malicious or harmful content anywhere on the site.

Additionally, violations of system or network security may result in civil or criminal liability. Warpwire will investigate occurrences and may involve, and cooperate with, law enforcement authorities in prosecuting the use or Users who are involved in such violations. You agree that you will not violate or attempt to violate the security of the site, including without limitation:

  • Attacking, probing, scanning, or testing the vulnerability of, breaching security of, disrupting, disabling or harming the site, or servers or networks connected to the site
  • Using the site via any automated means, such as a screen-scraper or robot. This is not intended to exclude the use of assistive technology for your own use, such as screen-readers
  • Sending any unsolicited emails to other Site Users or forging any TCP/IP packet header or any part of the header information in any email
  • Accessing data not intended for you or logging into a server or account you are not authorized to access
  • Attempting to interfere with service to any User, host or network, including without limitation, via means of submitting a virus to the site, overloading, "flooding", or "crashing"
  • Impersonating another person (or impersonating Warpwire) or improperly allowing another to use your login information to access the site
  • Use any element of our service (name, trademark, logo) without prior written consent
  • Let someone else use your account
  • Break any laws

What warranties are given

Warpwire shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data, or other losses (even if Warpwire has been advised of the possibility of such damages) in connection with this agreement, including, without limitation, any such damages resulting from: (a) the use or the inability to use the services; or (b) unauthorized access to or alteration of your content. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some or all of the above exclusions or limitations may not apply to you, and you may have additional rights.

Restrictions on allowed content

You represent and warrant that the upload and publishing on the Application of any content uploaded to the Application by you does not and will not infringe or violate the right of any third party, including without limitation any copyrights of third parties.

You also represent and warrant that you will not upload any material containing child pornography or obscenity, which is libelous or defamatory or otherwise malicious or harmful to any person or entity, which is discriminatory based on race, sex, religion, nationality, disability, sexual orientation or age, or the publication of which would violate any other law. You are responsible for the accuracy and substance of any content uploaded to the Application by you.

Warpwire complies with local and federal laws and the jurisdiction for any controversy, claim or dispute shall take place in Durham, North Carolina.

Copyright Law, Intellectual Property of Warpwire

You acknowledge and agree that the Application which operates the Warpwire is the exclusive property of Warpwire, and that Warpwire retains full title to the Application regardless of the form or media in which the original or copies may exist, that no interest of any kind in said Application is conveyed to you and that by accessing and using the Cloud Service you do not become the owner of the Application. You further acknowledge that all patent, copyright, trade secret, proprietary and other intellectual property right in the Application and any modifications and/or derivative works thereof are the sole and exclusive property of Warpwire. You further acknowledge that the Application, including the code, logic and structure, constitute valuable trade secret rights that belong to Warpwire.

Termination Terms

You understand that Warpwire may terminate your access at any time if you fail to abide by these Terms of Use.

Community Guidelines

You agree that you will not upload or create harmful content anywhere on the site, including without limitation the following:

  • Content that defames or threatens others
  • Harassing statements or content that violates federal or state law
  • Content that discusses illegal activities with the intent to commit them
  • Content that is not your own, or infringes another's intellectual property, including, but not limited to, copyrights, trademarks or trade secrets
  • Material that contains obscene (ie. pornographic) language or imagery
  • Content that is otherwise unlawful

Who owns created content

Warpwire does not and will not assert any ownership in the content unless such content was derived from Warpwire's intellectual property without authorization. You will not copy any content on the Application without proper authorization to do so from the owner of such content.
